Lao Wang is a Sichuan native. He came to Fuqing to work last year.

The processing plant goes to work.

The "boss" of this processing plant is Weng Mou, the two sides agreed to pay for the piece by piece, and the monthly salary is about 15 every month.

"When the factory is in good condition, it can get 3000~4000 yuan a month, and the time of payroll is also more punctual, which is much stronger than that in home farming."

At first, Lao Wang thought that he had found a good boss, but no one had ever thought that Weng would disappear without warning.

In January 21st this year, there was only one week left for the Spring Festival from 2012.

Weng Mou found the landlord of the workshop, said that he had found a new factory building, and had to load and pport most of the machines and equipment in the workshop.

After the pportation, Weng also disappeared.

Lao Wang recalls that the workshop became empty overnight, and the boss's phone could not get through, and no worker knew where the boss was going. "What is going on here? It's going to be new year, and the money has not gone out, but the boss has run away, and everyone is at a loss."

Later, Lao Wang and other workers went to Fuqing labor supervision department to complain.

According to statistics, the company owed wages to 64 workers such as Lao Wang from December 16, 2011 to January 18, 2012, totaling 156353 yuan.

The police investigation found that he was able to pay wages.

According to the Fuqing police, the company owed wages is "

Fuqing Feng Zhi Xiu Fashion Co., Ltd.

"It was established in April 30, 2010 with a registered capital of 1 million yuan. The legal representative is Zhang, but the actual manager of the company is Weng Mou.

After receiving the demands of workers for salary, Fuqing labor supervision department has issued two labor supervision instructions to the company's legal representative, Zhang Mou and the actual administrator, demanding that the workers' wages be repaid within a specified time.

The police officer of the Fuqing Public Security Bureau's public security management group said that after receiving the case, they were suspected of "

Malicious arrears of wages

Weng and Zhang went online to escape.

In October 24th, Weng Mou, who was hiding in Jiaocheng District of Ningde, was arrested by the police.

After receiving the case, Weng admitted that he owed the wages of 64 workers, such as Lao Wang, but he could not pay the workers' wages because of debt disputes. He could not take the equipment off the road.

But after investigation by the Fuqing police, Weng was fully capable of paying the salary.

"He has been doing this business for 30 years, and the triangle debts in the business field are very normal."

Police officer Lin police said that in the two years, the garment industry was in a recession, and Weng didn't make any money and wanted to "lose" the money.

After hearing that "malicious wages owed" to enter the sentence, Weng and his family's heart fluctuated.

In November 9th, Weng's family members raised the sum of 10 months' hard-earned money owed to migrant workers, and temporarily existed in the accounts of Fuqing Labor Bureau, which was used to return wages owed to workers.

At present, Weng Mou has been detained by Fuqing police in criminal cases.

The pursuit of another police officer Zhang is still in progress.

Malicious wage arrears can deterrent bad employers.

The reporter has learned that in the past, there are three main channels of normal pay for salary: one is to turn to the trade union; the two is to report to the labor supervision department; and the three is to entrust a lawyer.

In addition, it is through their own "soil approach" to pay.

The director of the Fujian yuan law firm, Lei Lei, said that "malicious wage arrears" is not only beneficial to workers, but also a deterrent to bad employers who like to run in arrears.

She Lei said, before the workers suffered malicious wages, rights are relatively difficult, "labor dispute cases in the past is a civil dispute, once the boss runs, the labor insurance department can not find it, it is useless to issue a rectification notice.

Appeal to the court, because the boss runs or pfers property, it is very difficult to carry out it.

After the "malicious wage arrears" entered the prison, once the boss ran out of pay, the laborers could appeal to the public security organs for help and pursue the criminal responsibility by the public security organs. "This is a deterrent to employers and a deterrent to these bosses."

Maximum wages for malicious arrears can be sentenced to seven years.

The forty-first provision of the amendment to the criminal law (eight) stipulates that, in order to escape the payment of laborers' remuneration or to pay the laborers' remuneration by means of pferring property or escaping from hiding, the amount is relatively large, and if the amount paid by the relevant government departments is still not paid, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention, and shall be fined or punished. If serious consequences are caused, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years, and shall also be fined.

If a unit commits the crime mentioned in the preceding paragraph, it shall be fined, and the person directly in charge and other persons directly responsible shall be punished in accordance with the provisions of the preceding paragraph.

The first two acts have not yet resulted in serious consequences. They may be relieved or exempted from paying labor remuneration and assuming corresponding liability for compensation before filing a public prosecution.
